SANTA FE, N.M. (NEWSnet/AP) — A New Mexico judge is considering Alec Baldwin's request to dismiss a grand jury indictment against him.

The indictment charges Baldwin with involuntary manslaughter in the October 2021 fatal shooting of cinematographer Halyna Hutchins on the set of “Rust.”

Baldwin has pleaded not guilty and his attorneys have urged dismissal.

The motion to dismiss the indictment argues the grand jury received inaccurate and one-sided testimony about the gun involved in the shooting.

On Friday, defense attorneys argued the prosecution neglected its responsibility to ensure impartial grand jury proceedings by withholding or steering jurors away from exculpatory evidence.

“The fix was in,” said defense attorney Alex Spiro. “There were no witnesses there to testify. There was no evidence binder of the defense exhibits … They never intended for the grand jury to ask for witnesses.”

Special prosecutors say they followed grand jury protocol and accuse Baldwin of “shameless” attempts to escape culpability. A jury trial is scheduled for July.

Prosecutors turned their attention to Baldwin after weapons supervisor Hannah Gutierrez-Reed was sentenced to 18 months in prison on an involuntary manslaughter conviction for Hutchins’ death.
