SANTA FE, N.M. (NEWSnet/AP) — A New Mexico judge has rejected a request by Alec Baldwin to dismiss the criminal charge against him in a fatal shooting on the set of “Rust.”

The decision removes one of the final hurdles for prosecutors to put Baldwin on trial in July.

Judge Mary Marlowe Sommer upheld an indictment charging Baldwin with one count of involuntary manslaughter in the 2021 death of cinematographer Halyna Hutchins. The judge rejected arguments that prosecutors had flouted rules of grand jury proceedings to divert attention from exculpatory evidence.

Baldwin has pleaded not guilty to the involuntary manslaughter charge.
